Terms of Use

1. Acceptance of Terms

By accessing or using selebri.com ("the Platform"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Platform.

We may update these Terms at any time. Continued use after changes are posted constitutes acceptance of the revised Terms.

2. About Selebri

Selebri is an online service provider that connects fans with Ukrainian artists for personalised video greetings delivered via live or recorded video call. Selebri acts as a service provider; the video greeting is facilitated and delivered through the Selebri platform.

3. Eligibility

• You must be at least 18 years old to create an account and place bookings.
• If you are booking on behalf of a minor (e.g. as a gift), you confirm that you are the parent or legal guardian and that the content requested is appropriate.
• You must provide accurate and complete registration information.

4. User Accounts

• You are responsible for keeping your account credentials confidential.
• You are responsible for all activity that occurs under your account.
• Notify us immediately via the contact page if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Bookings and Payments

• All prices are displayed in the currency shown on the artist's profile and are inclusive of any applicable platform fee.
• Payment is processed at the time of booking via Stripe. Funds are held in escrow and released to the artist only after the video greeting is delivered.
• An artist may accept or decline a booking request. If declined, you will receive a full refund within 5–10 business days.
• If an artist fails to deliver within the agreed timeframe, you are entitled to a full refund. Contact us via the contact page to initiate a refund.
• Completed bookings are non-refundable unless the delivered video materially differs from what was requested.

6. Video Calls and Content

• Video sessions are hosted by Daily.co. By joining a call you agree to Daily.co's Terms of Service.
• You must not record, redistribute, or commercially exploit video content without the explicit written consent of the artist.
• Personal use sharing (e.g. sending the greeting to the recipient) is permitted.
• You must not request content that is unlawful, defamatory, hateful, sexually explicit, or violates any third-party rights.
• Artists reserve the right to decline requests they find objectionable, and will not be penalised for doing so.

7. Artist Obligations

Artists who register on the Platform agree to:

• Provide accurate profile information, including name, bio, and pricing.
• Respond to booking requests within the timeframe stated on their profile.
• Deliver video greetings that meet the quality and content of the agreed booking.
• Complete Stripe Connect onboarding to receive payouts. Selebri cannot release funds to artists without a verified Stripe Connect account.
• Comply with all applicable tax obligations in their jurisdiction.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Attempt to bypass, disable, or interfere with the Platform's security features.
• Scrape, crawl, or harvest data from the Platform without permission.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Post or transmit viruses, malware, or any other harmful code.
• Circumvent the platform by arranging payments with artists outside of Selebri for bookings originated on the Platform.

9. Intellectual Property

All platform content — including the Selebri name, logo, design, and software — is owned by or licensed to Selebri and protected by applicable intellectual property laws.

Video greetings remain the intellectual property of the artist. By purchasing a booking, you receive a personal, non-exclusive, non-transferable licence to view and share the video for personal, non-commercial purposes only.

10. Disclaimers

The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that:

• The Platform will be uninterrupted or error-free.
• Artists will fulfil all bookings to your satisfaction.
• The Platform will be free from viruses or other harmful components (though we take reasonable steps to prevent this).

11. Limitation of Liability

To the fullest extent permitted by law, Selebri's total liability to you for any claim arising out of or relating to the Platform shall not exceed the amount you paid for the booking giving rise to the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits or data.

12. Governing Law

These Terms are governed by the laws of Ukraine. Any disputes shall be resolved in the courts of competent jurisdiction in Ukraine, unless otherwise required by applicable consumer protection laws in your country of residence.
